Renter represents that they are legally qualified to operate the rented boat.

Renter agrees to comply with all applicable federal, state, and local boating laws and regulations, including all posted signage.

No person under the influence of alcohol, drugs, or impairing substances may operate the boat.

• The vessel shall only be used for recreational boating purposes.

• The vessel may not be used for racing, unlawful activity, or commercial operation.

• Smoking, illegal drugs, and conduct that High Country determines in its sole discretion is dangerous are prohibited.

• Unauthorized operation of the vessel is prohibited.

• The vessel shall not be operated outside approved waterways and boundaries.

• Renter acknowledges receipt of all required safety equipment.

• Renter has completed the Pre-Rental walk-through process, has signed off on the Pre-Rental walk-through & Checklist and acknowledges that all items on the Checklist are satisfied.

• The Renter and all passengers must comply with personal flotation device (PFD) requirements and boating laws. All passengers on the boat must have a properly fitting PFD on board the vessel at all times..

• Children must wear properly fitted PFDs at all times while on the vessel.

• Emergency procedures must be reviewed.

Renter acknowledges the vessel has been inspected prior to departure.

The vessel is accepted in good operating condition unless specific issues are noted in writing on the rental agreement.

• Renter assumes sole responsibility for all loss or damage during the rental period.

• Renter acknowledges that in High Country’s sole discretion, Renter is solely responsible for all costs of repair, cleaning, theft, towing, fuel shortages, damage, and other costs that arise during the rental period.

• Renter is solely responsible for any citations, fines, penalties, and violations.

• Damage assessments may include labor, parts, downtime, transport, and administrative costs.

• Lost, stolen, or damaged equipment may result in replacement and/or repair charges.

• Renter is responsible for fuel costs as set forth in this document.

• Boating and other water activities involve risks (inherent and otherwise) that among other things, may cause injuries, death, and property damage. All renters, and members of their group aged 12 or above, must read and sign the High Country Boat Rentals, LLC: Participant and Parent Acknowledgment and Assumption of Risks & Release and Indemnity Agreement as a condition of partaking in any High Country activity, including riding on a vessel.

High Country may delay, cancel, or terminate rentals due to unsafe, or potentially unsafe, weather or water conditions.

Weather-related refunds, credits, or rescheduling are offered at High Country’s sole discretion.

• In the event of an accident, damage, malfunction, injury or other medical event, grounding, collision, theft, fuel shortage, or mechanical failure, Renter must contact High Country via telephone at (970) 401-0959 immediately.

• Renter agrees to never abandon the vessel and to cooperate fully with authorities and High Country.
